Welcome to Giveaway, organized by Surfshark B.V. (hereinafter — “we,“ “our,“ “us,“ or “Surfshark“), where game participants (hereinafter — “You,“ “Your,” “Yourself,” “Participant,“ or “Participants”),  have a chance to win an airline (American Airlines or Iberia, or Turkish Airlines, or Delta, or SAS) gift card worth 1000 USD/EUR* (hereinafter — the “Giveaway”). Get ready to soar to new heights!

*Giftcard currency will depend on selected airlines.

Giveaway organizer

• The one and only Giveaway organizer is Surfshark B.V., Kabelweg 57, 1014BA Amsterdam, the Netherlands, registration number: 81967985; 
• Surfshark clearly states that none of the airlines specified in these Rules are in any way sponsoring this Giveaway, nor are they in any partnerships with the Organizer.

Giveaway Participants

• To take part in this Giveaway, you must be 18 years old or older, agree to our Terms and Conditions (hereinafter — the “Terms“) and embrace receiving our groovy marketing newsletters! No location restrictions apply, meaning you can be from anywhere in the world;
• As much as we love our crew, Surfshark employees and their family members cannot participate in this Giveaway. Sorry, dear sharks, but this one is for our amazing supporters;
• Participants in the Giveaway must be in full compliance with all applicable laws, including international sanctions lists, which are administered by the Office of Foreign Control of the US Department of the Treasury, the US Department of State, the United Nations Security Council, the European Union, His Majesty’s Treasury of the United Kingdom, or other relevant sanctions authority. Make sure You’re not caught in the treacherous waters of sanctions. Your safety and adherence to legal requirements are of utmost importance to us. Unfortunately, if you find Yourself subject to any sanctions, we might have to disqualify you from the Giveaway. 
• Please note that this Giveaway is offered to all Participants across the world under the same conditions. If mandatory laws of your country set certain restrictions for such promotions, please refrain from participating in the Giveaway;
• Should You ever feel the need to sail away from this grand adventure, no worries! You can withdraw from the Giveaway at any moment. Just send us a message at socialmedia@surfsharkteam.com and your entry will be removed.

Participation

Participating is a breeze. Just follow these simple steps:

1. Create a Surfshark account and download the app on your mobile device or computer. 
2. Go to your favorite location (whatever it may be!), open the Surfshark app, connect to the nearest server, and take a photo of your device. Be as creative as you can be, but make sure your device is in the center of the photo and the app is clearly visible.  A VERY VERY important rule: no sensitive data or human faces are allowed in this visual realm, so make sure the photos You post do not include any other human beings! In other words — ensure that Your photo does not breach any rights of any third parties and / or any applicable laws. Remember, a violation may mean disqualification. Keep it safe, keep it fun, and let the stunning visuals speak for themselves!
3. Post your masterpiece on social media (if Facebook – add @SurfsharkPrivacy, if  Instagram or Twitter – add @Surfshark), and make sure to use the hashtag #SurfsharkGiveaway. 
4. To ensure we don’t miss your entry, tag the official Surfshark account (@Surfshark on Instagram and Twitter and @SurfsharkPrivacy on Facebook) in your caption or post. 

• Have a few photo ideas? Great! You can submit multiple entries with different unique pictures to increase your chances of winning!
• Remember: by embarking on our wild Giveaway ride, You agree with these rules. If you do not follow them, You shall be deemed ineligible to partake in this Giveaway.

Giveaway period

• The Giveaway will be going on from July 1, 2023, to September 30, 2023.
• On October 2, 2023, five entries will be chosen. Our jury will then take two weeks to carefully evaluate the five candidates. On October 16, the winner will be announced!

Prize

• The winner of this Giveaway will receive a gift card worth a whopping 1000 USD/EUR for a journey through the skies with proposed airlines!
• This prize is non-transferable, meaning You can’t give it to your long-lost cousin or trade it for a barrel of virtual laughs. So, you can’t exchange this prize for cash, gold bars, or unicorn tears. It’s all about the flights! 

Winner

• The winner will be announced on October 16, 2023;
• We’ll be running this Giveaway across multiple social media platforms (Facebook, Instagram, Twitter, Reddit, and Discord), but there will only be one winner. Please note, this Giveaway is in no way sponsored, endorsed, administered by, or associated with any social media platform;
• Our jury will sift through the sea of submitted photos from all platforms and choose one winner;
• We’ll contact the winner via DM on the social media platform they used for participation. Keep an eye on Your notifications because Surfshark might come knocking on Your virtual door!
• The winner must respond within 5 days of the initial contact to claim the prize. Failure to do so will result in disqualification, and an alternate winner will be chosen;
• Bear in mind that Surfshark is not responsible for any issues or complications that may arise from the winner’s use of the gift card. The winner is solely responsible for complying with the terms and conditions set forth by the particular airline, including but not limited to booking procedures, travel restrictions, availability, and any additional costs or fees associated with the ticket. Surfshark is not liable for any losses, damages, or claims related to the usage or redemption of the airline ticket coupon. So, make sure You’ve read the particular airline’s rules.
• The five finalists must provide their correct personal details to the Organizer for internal due diligence and — of course —  for awarding the prize to one of them!
• As the winner, You grant Surfshark the honor and right of using Your name, submitted picture, and social media handle for promotional purposes.

Intellectual property

• By joining our contest, you keep the ownership of your brilliant work and give Us the license to promote, display, and modify your UGC (User-Generated Content) worldwide — potentially making You famous in the process!
• Originality is key: no copying, please! By submitting Your UGC, You promise it’s original and won’t infringe on anyone else’s intellectual property;
• Lights, camera, publicity: We’re excited to share Your greatness with the world! By participating, you agree to let Us use Your name, social media handle, and bio to promote the contest;
• Stay out of trouble: You’re the boss of Your content, but please make sure it’s legal. If any legal issues arise from Your UGC, You’ll take full responsibility and protect Us from any claims. Let’s keep things drama-free!
• Changes happen: We reserve the right to modify or end the contest whenever necessary, including the use of Your UGC. Don’t worry — if we part ways, we won’t use your stuff anymore (unless required by law or if you allow us to continue doing so).

Limitation of liability

• Ok, now this is a serious part, so bear with us: notwithstanding the terms of service, neither Surfshark, nor any parent companies, affiliates, subsidiaries, agents, and licensees, and the officers, directors, owners, shareholders, employees, representatives, and agents of each of the foregoing (collectively, the “Released Parties”) are not responsible, and will have no liability for:

1. late, delayed, illegible, damaged, corrupted or incomplete entries by the participants, incorrect or inaccurate capture of loss of entry information or any other human or technical errors of any kind relating to the operation of the Giveaway, the communications or attempted communications with any participant, the submission, collection, storage, or processing, or the administration of the Giveaway;
2. any Force Majeure Event or any other event outside their control that may cause any alteration, postponement or cancellation of any part of the Giveaway;
3. any damage to any computer system or mobile device resulting from the Entry in or accessing or downloading information in connection with this Giveaway.

• By accepting, a Participant fully releases, covenants not to sue, and agrees to hold each of the Released Parties harmless from and against any and all claims and liability arising out of the operation of the Giveaway, the Entry in the Giveaway, the acceptance, receipt or use (or misuse) of any Prize. The Participants assume all liability for any damage caused or claimed to be caused by the Entry in this Giveaway or the acceptance, receipt, or use of any Prize;
• To the fullest extent permitted by laws, in any case, the liability of Surfshark shall not exceed the price of the prize and shall not include attorney fees or court costs;
• If, for any reason, a person’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the entrant’s sole remedy is another entry in the Giveaway.

Governing law

• The laws of the Netherlands shall rule over this Giveaway. Should any disputes arise from this epic adventure, the courts of the Netherlands shall be the ultimate judge.

Privacy notice for participants of the Giveaway

Thank you for participating in our Giveaway. This Privacy Notice explains how Surfshark B.V. (hereinafter — “we” or “Surfshark”) collects, uses, and protects your personal data in relation to the Giveaway. We are committed to ensuring the privacy and security of your personal information and complying with applicable data protection laws, including the General Data Protection Regulation (GDPR).

1. Purposes of processing

We will process your personal data for the following purposes:

• Organizing the Giveaway effectively;
• Selecting the winner of the Giveaway;
• Contacting the winner of the Giveaway.

The personal data we process may include:

• The fact of whether the person has won;
• Communication with the contestants;

We will store your personal data for the duration of the Giveaway.
