Surfshark Giveaway Rules

1. Eligibility

• 1.1. The Surfshark Giveaway (the “Giveaway”) is open to natural persons (the “Participant” or “Participants”) residing worldwide, except where prohibited by law.
• 1.2. Participants must be at least 18 years of age at the time of entry.
• 1.3. Participants must have read and accepted Surfshark's Terms of Service (available here: https://surfshark.com/terms-of-service) before purchasing a Surfshark subscription.
• 1.4. By proceeding, the Participants acknowledge that they have read Privacy Notice for Participants of Giveaway (Annex 1 to this Surfshark Giveaway Rules) and the Calm Gift Card Terms and Conditions (https://www.calm.com/terms), as well as understand that compliance with these terms is their responsibility. This includes the understanding that it is the Participant’s responsibility to identify and adhere to any restrictions specified in these terms.
• 1.5. The free trial automatically renews into a 1-year subscription at the then-current retail price in your territory, then automatically renews each year at the then-current retail price until cancelled; cancel any time. Only available to Surfshark subscribers. Not available to customers who have used a Calm Premium free trial in the past. Offer valid through January 1, 2027. Additional terms and conditions apply.
• 1.6. If you decide not to participate in this Giveaway, you can always do so by writing an email to: support@surfshark.com.
• 1.7. Employees of Surfshark and affiliated entities are not eligible to participate.

2. Giveaway period

2.1. The Giveaway will begin on February 24, 2026, at 02:00 AM EST and end on March 23, 2026, at 02:00 AM EDT (the Giveaway Period).

3. How to participate

• 3.1. To enter the Giveaway, Participants must, during the Giveaway Period, purchase any Surfshark 1-year or 2-year subscription (Surfshark Starter, Surfshark One, or Surfshark One+). Eligibility is open to Participants located worldwide, as verified by the Participant's IP address.
• 3.2. Subject to availability, each Participant will receive one Gift (as described below) for each valid subscription purchased following these Rules.

4. Gift and delivery

• 4.1. Subject to availability, each Participant who follows these Rules will be eligible for the https://www.calm.com/ 1 year subscription coupon. 
• 4.2. The Gift code must be redeemed solely via the dedicated redemption page at https://www.calm.com/partnership/surfshark-12m and cannot be redeemed through any other channels.
• 4.3. The Gift will be provided (subject to availability) to Participants who have not refunded their subscription within 30 days from the moment of purchase (any subscriptions purchased during the Giveaway period and subsequently canceled are not eligible for the Gift).
• 4.4. The Gift will be delivered to the Surfshark web application associated with the specific Surfshark account the day after the refund period ends.
• 4.5. Surfshark does not assume any responsibility if the Participant loses access to Surfshark web application or fails to redeem the Gift within the established term without the fault of Surfshark. Furthermore, Surfshark is not liable for:
• 4.5.1. Inaccuracy or incompleteness of the Participant's provided details required for coupon redemption.
• 4.5.2. Any technical malfunctions, interruptions, or errors that may occur during the coupon generation, transmission, or redemption process, whether caused by the Participant's equipment, software, or internet service providers.
• 4.5.3. Unauthorized access, use, or tampering with the redemption system, coupons, or any related mechanisms by third parties.
• 4.6. IMPORTANT:
• 4.6.1. The quantity of Gifts is limited. Gifts are provided on a first-come, first-served basis while supplies last. Surfshark is not obligated to provide a Gift once the supply is exhausted, even if the Participant meets all other eligibility criteria.
• 4.6.2. Eligible Participants may redeem and activate the Gift starting from the moment they become eligible (i.e., after the 30-day refund period) until May 23, 2026. This deadline applies to all Participants, including those whose eligibility period begins after the Giveaway Period has ended. If the Gift is not redeemed and activated by May 23, 2026, it will expire and cannot be redeemed later.

5. General Conditions:

• 5.1. Surfshark reserves the right to disqualify any Participant who violates these Rules or attempts to manipulate the entry process or the operation of the Giveaway.
• 5.2. Surfshark reserves the right to cancel, suspend, or modify the Giveaway if any fraud, technical failures, or other factors beyond Surfshark's control impair the integrity of the Giveaway.
• 5.3. Surfshark is not responsible for lost, late, incomplete, or misdirected entries or for any computer-related, online, or technical malfunctions that may occur during the entry process.
• 5.4. The Participant hereby agrees to be in full compliance with all applicable laws, including but not limited to international sanctions. Failure to adhere to these legal obligations may result in disqualification or other appropriate actions as determined by Surfshark.

Annex 1

Privacy notice for participants of the Giveaway

This Privacy Notice explains how Surfshark B.V. (we or Surfshark) collects, uses, and protects your personal data in relation to the Giveaway. We are committed to ensuring the privacy and security of your personal information and complying with applicable data protection laws, including the General Data Protection Regulation, UK GDPR, California Consumer Privacy Act (collectively referred to as “Privacy laws”).

1. Purposes of processing

We will process your personal data for the following purposes:

• Organizing the Giveaway effectively;
• Contacting the Participant of the Giveaway;
• Delivering the Gift.

2. Personal data processed

The personal data we process may include:

• E-mail address;
• The fact of whether the person has bought a subscription;
• Subscription ID, date of purchase, attribution link;
• IP address and the country;
• Communication with the Participant;
• Information about the Gift and information needed for Gift delivery.

Your personal data processed for the above described purposes will be retained for as long as the Gift may be redeemed and will be deleted no later than 6 months after that.

The Giveaway is governed by Rules that the Participants agree to, therefore, we have a necessity to process your personal data for the performance of a contract.

3. Data recipients

Your personal data may be transferred to and stored in countries outside the European Economic Area (EEA), where data protection laws may differ. In such cases, we will ensure that adequate safeguards are in place to protect your personal data, as required by applicable data protection laws, specifically by entering into the standard contractual clauses with the data recipients established outside the EEA.

4. Children’s privacy

This Giveaway is not intended for individuals under the age of 18. We do not knowingly collect personal data from individuals below this age. If you believe that we have inadvertently collected personal data from a child, please contact us to request the deletion of such data.

5. Automated decision-making

We do not use automated decision-making processes, including profiling, to make decisions that significantly affect you.

6. Data protection rights

As a data subject, you have certain rights under the Privacy laws, including:

• The right to access and obtain a copy of your personal data;
• The right to rectify any inaccurate or incomplete personal data;
• The right to the erasure of your personal data under certain circumstances;
• The right to restrict the processing of your personal data in certain situations;
• The right to object to the processing of your personal data;
• The right to data portability, allowing you to receive your personal data in a structured, commonly used, and machine-readable format;
• The right to withdraw your consent at any time (if processing is based on consent);
• The right to lodge a complaint with a supervisory authority if you believe that your data protection rights have been infringed.

In addition to the above rights, the following rights (which may be subject to certain exemptions or derogations) shall also apply to individuals covered by the CCPA:

• The right to opt out of the sale or sharing of your personal information to third parties;
• The right to not receive discriminatory treatment if and when you exercise your privacy rights under the CCPA;
• The right to limit use of sensitive personal information.
